FEES: Must be agreed before publication.
RIGHTS: We sell reproduction rights only. Re-use of material merits a further fee, including further editions, foreign language editions, advertising, CD-ROM and Internet. Notwithstanding any other contracts or agreements between VALAN PHOTOS and the purchaser, no rights are assigned until payment of our invoice is received.
COPYRIGHT: Remains the property of the photographer. Sale of copyright takes place only under special terms and conditions negotiated on behalf of the photographer and with his/her permission.
SERVICE FEE: Unless agreed otherwise, the service fee will be $45.00 minimum or $0.45 per slide, applicable only when there is no purchase. If a project is cancelled VALAN will charge research fees for the time spent.
HOLDING TIME: Is 21 days unless VALAN agrees otherwise. In the case of book research first returns should be received within 28 days. If a transparency has been held for reproduction it should be returned within a period of 4 months. If the agreed length of time is exceeded without permission then there will be a charge of $2.00 per transparency per week.
RETURN OF TRANSPARENCIES: All transparencies must be returned. Those reproduced must be accompanied by their original mounts showing the subject, author, and file number of the image. This is the responsibility of the client. Any extra expenses incurred in retrieving slides or tracing slide mount information will be charged to the client. Packages must be firm and secure with slides packed between card to prevent crushing or bending. Delivery to and from VALAN must be by hand, by bonded courier, or by registered mail. Do NOT use U.P.S. or Expresspost. Material being returned from the U.S. and other countries outside Canada should be shipped by Federal Express or Registered Mail and should state "CANADIAN GOODS BEING RETURNED, NO COMMERCIAL VALUE". Any stated valuation for Customs purposes should be a maximum of $0.50 Canadian per slide (film value).
DAMAGE OR LOSS: All transparencies must be returned in good condition. A charge of $500.00 to $1500.00 will be made for any lost or damaged original transparency.
CREDIT LINE: All photographs used for editorial purposes must carry the name of the photographer and the agency e.g. J. A. Wilkinson/VALAN. Omitted or incorrect captions merit a 50% increase in fee.
PAYMENT: Must be made within 30 days of invoice date. Unpaid accounts will be charged at a rate of 2% per month, 24% per annum.
SAMPLES: It is the responsibility of the client to provide, free of charge, at least two copies of the finished product as evidence of use.
CAPTIONS: Will be as correct as possible, but VALAN cannot be held responsible for inaccuracies.
MODEL RELEASE: Exists only when VALAN sends confirmation in writing. Liability for any claims concerning photo use shall be limited to the amount paid to us for the reproduction rights on that photograph.
